RE: Meeting of the UIA International Bar leaders Senate

Casablanca (Morocco), Saturday, 9 April 2011

 

 

Dear Presidents,

 

We are pleased to inform you of the date and discussion topic for the next meeting of the International Bar Leaders Senate, which the International Association of Lawyers (UIA) will organise on Saturday, 9 April 2011 in Casablanca (Morocco).

 

The topic for this meeting will be:

"Confidentiality today:

can this fundamental right, which must be protected, become a deceptive illusion?"

 

- Confidentiality, which is the foundation on which attorney-client trust is built, frequently comes under attack:

a) By the public authorities, for example, through wiretaps, searches and police records;

b) By lawyers themselves, through insidious practices, such as sub-contracting certain work or services to outside professionals (outsourcing).

 

 - Confidentiality, which protects the right to privacy to which all citizens are entitled, is continually threatened:

a) By the public authorities, with the proliferation of security techniques such as geolocation or surveillance cameras;

b) By citizens themselves, through the widespread development and use of social media (Facebook, Twitter, etc.)

 

Are there contradictions between this demand for confidentiality and the quest to adopt a different lifestyle, as well as a new way of practising our profession?

 

These are the topics we invite you to consider. We will attempt to find international legal solutions in order to guarantee the right to confidentiality, as well as strengthen general trust in the information society, at a time when there is so much focus on digital memories.
